Legal System Responds With Tougher Punishments for Woman in Her 30s Over Baseless Rape Allegation

A woman, now in her thirties, fabricated a narrative accusing her own biological father of the heinous crime of rape merely because he declined her monetary requests. Her father had been financially supportive of her education abroad. This grave misuse of trust has led to her incarceration.

Recent reports from the legal sector, dated the 1st, reveal that the Criminal Division 1 of the Uijeongbu District Court's Namyangju Branch, under the authority of Presiding Judge Choi Chi-bong, has sentenced a woman, referred to as A, to a ten-month imprisonment. Her convictions include defamation, business obstruction, and making insults.

The legal proceedings against A were prompted after she made 11 defamatory posts in an online forum between May and June of the previous year. Her posts, under the provocative title "I am a victim of familial sexual violence. Please look at this," maligned her father, B, with baseless allegations.

In these online accusations, she deceitfully stated, "Since the age of four, I have been subjected to ongoing sexual assaults by my biological father," and further alleged that her mother endured domestic and sexual abuse too. She claimed they had settled the issue for 30 million won and called for severe repercussions for her father.

Adding to the seriousness of her actions, A disclosed her father's identity and business details, causing significant operational challenges for him.


 


A further complicated her father's personal life by making six additional posts, accusing him of having an affair and remarrying a woman named C.

In February 2021, A escalated the matter by initiating a lawsuit against B at the Incheon District Court, seeking compensation for the alleged sexual assaults. However, she failed to substantiate her claims with any credible evidence.

During her criminal court trial, A maintained that the content of her posts was truthful. Nevertheless, the court, influenced by the civil lawsuit’s outcome, rejected her arguments. It highlighted the absence of concrete evidence or circumstances that supported her claims of habitual sexual assault by her father.

The court reasoned that A's allegations were likely false, particularly given the financial support she received during her education abroad and after her return. The accusation appeared suspiciously timed, following her father's refusal to fund her proposed café venture with a substantial sum.


The judge articulated the gravity of the situation, saying, "Her actions stemmed from dissatisfaction over financial denial, leading her to publish false accusations. The irreversible damage inflicted on the victims' reputations is profound."


Explaining the rationale behind the sentencing, the court noted, "The defendant poses a high risk of reoffending, evidenced by her continued dissemination of similar falsehoods post-crime. Coupled with the victims' strong demand for stringent punishment, these elements were critical in determining the sentence."
